Fair Use Policy

This comprehensive Fair Use Policy outlines acceptable infrastructure boundaries, CPU, storage, and network resource guidelines to ensure premium, high-speed performance for all users.

# 1. Expanded Introduction & Purpose

Welcome to SkyRainCloud. This Fair Use Policy ("Policy" or "FUP") defines the acceptable use parameters, resource limitations, and behavioral expectations governing all Services, systems, networks, websites, and infrastructure provided by SkyRainCloud. The primary purpose of this Policy is to protect the stability, security, speed, and continuous availability of our hosting infrastructure. Because resources are shared to maintain cost-efficiency, a single user's excessive consumption or abusive workloads can negatively impact others on the same host node. This Policy establishes clear boundaries to prevent resource monopolization, server abuse, and network degradation.

# 2. Definitions

For the purpose of this Policy, the following definitions apply:

  • - "Shared Resources": Core CPU execution cycles, physical RAM memory space, GPU components, local NVMe storage arrays, host network interface cards (NICs), and IPv4/IPv6 address blocks shared by multiple virtual instances.
  • - "Shared Host Node" or "Hypervisor": The physical bare-metal hardware system running virtualization software that partitions physical server resources into multiple virtual containers or virtual machines.
  • - "Excessive Resource Utilization": Any workload that consumes a disproportionate amount of a Shared Host Node's processor, memory, network bandwidth, or storage IOPS capacity over a sustained period, causing performance degradation for other virtual instances on the same host.

# 3. General Fair Use Principles

Our infrastructure is designed for multi-tenant efficiency. Customers are expected to operate their services with courtesy, technical compliance, and respect for neighboring instances. You must not use our hosting platforms to run tasks that cause extreme bottlenecks or intentionally crash virtual machines. All workloads must be optimized, configured cleanly, and free from memory leaks or runaway network socket requests.

# 4. CPU, RAM, GPU & Shared Resource Usage

Customers utilizing shared-virtualized instances (such as Game Hosting, standard VPS, and shared Web Hosting) must adhere to these resource usage thresholds:

  • - CPU Throttling: Continuous CPU consumption exceeding ninety percent (90%) of the allocated virtual cores for a duration of more than sixty (60) minutes is considered resource monopolization. Runaway CPU tasks will be automatically throttled to preserve node stability.
  • - RAM Allotments: Memory allocations are strict boundaries. Attempts to allocate more memory than provisioned via swap bypasses or memory ballooning hacks are prohibited.
  • - GPU Workloads: In instances equipped with shared graphics processors (GPUs), continuous 3D rendering, video encoding pools, or synthetic graphics tasks must not block other tenants' access to physical graphics units.

# 5. Storage & Disk I/O Policies

To maintain high-speed file operations on our datacenter NVMe SSD storage networks:

  • - Disk operations must not execute continuous, high-frequency read/write commands (disk looping, intensive database queries without RAM caching, or continuous file indexing).
  • - IOPS allocations are dynamically limited on shared nodes. Services that generate severe, continuous IOPS bottlenecks that slow down the hypervisor's disk operations will have their storage bandwidth dynamically limited.

# 6. Network & Bandwidth Usage

Network bandwidth allocations are provided for standard web traffic, game server gameplay, and application communication. Prohibited activities include:

  • - Continuous, high-speed file transfers that saturate network ports.
  • - Running public proxy servers, Tor relays, or open virtual private networks (VPNs) that route external transit traffic through our shared network ports.
  • - Operating speed test loop scripts or high-frequency traffic reflectors.

# 7. IPv4 & IPv6 Address Usage

IP addresses allocated to Customer instances must be used in compliance with network regulations:

  • - IP address spoofing, MAC address cloning, or BGP route hijacking is strictly prohibited.
  • - Customers must not configure arbitrary IP addresses on their network interfaces that have not been explicitly allocated to them.
  • - Engaging in activities that cause our IP subnets to be blacklisted by security registries, spam blockers, or third-party web platforms is a material breach.

# 8. DDoS Protection & Network Abuse

All inbound network traffic is protected by automated DDoS mitigation filters. However, network abuse is strictly regulated:

  • - Outbound DDoS attacks, network probing, packet flooding, or unauthorized port scanning originating from your instance will result in immediate termination.
  • - If an inbound volumetric attack is so severe that it bypasses standard mitigation filters and threatens the connectivity of the entire host node, SkyRainCloud will null-route the Customer's IP address until the attack subsides.

# 9. VPS & Dedicated Server Rules

Virtual Private Servers (VPS) share physical node components with other tenants, whereas Dedicated Servers do not. The following rules govern their operations:

  • - VPS instances must not run kernel modifications or virtual interface configurations designed to bypass hypervisor security controls.
  • - Dedicated Server customers, though entitled to full raw resource usage, must not configure custom network loops or execute activities that degrade the central switch ports of the data center.

# 10. Game Hosting Fair Usage

Game Hosting instances (e.g., Minecraft, Steam games) are hosted on shared node processors. To ensure low ping times for all game instances:

  • - Running heavy external automations, bots, web panels, or database instances inside the game directories that are not related to active gameplay is prohibited.
  • - Game plugins or mods that contain memory leaks, cause CPU looping, or flood system logs must be removed or optimized immediately.

# 11. Unlimited Storage Policy

Certain game hosting plans include "Unlimited Storage." This storage is provided strictly and exclusively for active game files (e.g., worlds, configs, active modpacks, and server logs). Prohibited storage uses include:

  • - Storing personal backups, local device media files, movie collections, or software installers.
  • - Running a file sharing portal, download directory, or web hosting mirrors inside the game directories.
  • - Retaining more than three (3) full backup archives in the local directories. Customers must download backups to their local devices or store them on remote cloud storage.

# 12. Web Hosting Policy

Shared Web Hosting space is allocated solely for the storage of files directly related to active, publicly accessible web pages. Web hosting plans must not be used for:

  • - Hosting file download directories, software distribution mirrors, or media streaming hubs.
  • - Database storage for applications hosted outside SkyRainCloud's network.
  • - Automated website crawling, batch image processing, or high-load content generation scripts.

# 13. RDP Hosting Policy

RDP Hosting instances must be used for standard administrative, desktop, or workspace tasks. Prohibited activities include:

  • - Running automated botting systems (social media farming, account creation scripts, mass messaging).
  • - Executing continuous video rendering, video stream transcoding, or audio processing software on shared nodes.
  • - Running network stress testing or vulnerability scanning tools.

# 14. Backup & Archive Storage Rules

SkyRainCloud hosting environments are designed for active operations, not general data archiving:

  • - Storing server configuration backups, system snapshot files, or databases that are no longer active is prohibited.
  • - Storage space must not be used to store data retrieved from external sources for archiving purposes.
  • - Dedicated backup storage add-ons must only contain backups of services actively running on SkyRainCloud.

# 15. Email & SMTP Usage

Our IP networks must be protected from spam blocklists. SMTP and email sending are governed by these limits:

  • - Bulk email sending, newsletter distribution, marketing campaigns, or transactional spam are strictly prohibited.
  • - Shared instances are restricted to a maximum of fifty (50) emails per hour for transactional application messages.
  • - Running an open mail relay or spoofing email header envelopes will result in immediate port blocks.

# 16. API Usage

Customers accessing third-party APIs or exposing APIs from their instances must configure their applications responsibly:

  • - High-frequency API polling, socket abuse, or DDoS-like API request bursts are prohibited.
  • - APIs hosted on our servers must implement rate limiting filters to protect the shared host node's TCP network stack.

# 17. Acceptable Automation

Automation scripts, cron jobs, and custom deployment routines are permitted provided they meet the following criteria:

  • - Automated tasks must be staggered and run during off-peak hours (e.g., database synchronization, log rotations).
  • - Loops must include sleep statements and rate limits to prevent CPU spikes.
  • - Automated scraping of external portals is prohibited if it violates target terms of service.

# 18. Cryptocurrency Mining Restrictions

SkyRainCloud maintains a strict zero-tolerance restriction on cryptocurrency mining:

  • - Running miners (e.g., Monero, Bitcoin, Chia) or cryptojacking utilities on shared virtual instances, VPS, or GPU servers is completely banned.
  • - Unused disk plotting (Chia) is prohibited due to the extreme wear it causes on datacenter solid-state drives.

# 19. AI/ML & GPU Workloads

Artificial Intelligence (AI), Machine Learning (ML), and neural network operations are restricted under the following conditions:

  • - Model training, deep learning iterations, and continuous neural network processing are permitted only on Dedicated Servers or GPU-optimized plans designed for these workloads.
  • - Running AI inference models on standard shared CPU instances is prohibited if it creates resource bottlenecks.

# 20. High Availability & Clustering Rules

When configuring database clustering, network replication, load balancing, or high availability (HA) environments:

  • - Heartbeat, sync, and network replication traffic must be throttled to prevent port congestion.
  • - Multicast configurations are disabled on shared virtual networks and must only be configured in isolated private VLANs.

# 21. Third-Party Platform Compliance

All applications hosted on SkyRainCloud must comply with the guidelines, terms of service, and API policies of the respective platforms they access. It is the Customer's responsibility to obtain necessary permissions, licenses, and access credentials from third-party systems before routing traffic through our networks.

# 22. Security Responsibilities

Hosting security is a shared model. While we protect the physical node and hypervisor layers:

  • - The Customer must keep their operating system kernels, service modules, and applications updated and securely patched.
  • - Accounts with weak passwords, open proxy ports, or vulnerable configurations that allow intrusion will be suspended to protect our network integrity.

# 23. Abuse Reporting

SkyRainCloud maintains a dedicated channel for network, spam, copyright, and security abuse reporting. Reports must contain valid headers, target IP addresses, timestamps, and log files. Abuse complaints can be submitted via:

# 24. Monitoring & Investigation

To ensure network security, SkyRainCloud monitors system vitals and routing metrics:

  • - We utilize automated hypervisor monitoring systems that measure resource usage, network packet counts, and connection anomalies.
  • - If resource abuse, intrusion, or prohibited activities are detected, our engineers reserve the right to audit server logs, inspect running system processes, or suspend network ports to investigate the incident.

# 25. Enforcement Procedures

In the event of a Policy violation, SkyRainCloud will implement enforcement measures based on the severity of the incident:

  • - Throttling: CPU allocations, disk IOPS, or network speeds will be limited automatically.
  • - Process Termination: Runaway, malicious, or unoptimized processes will be stopped.
  • - Temporary Suspension: The service will be paused to allow the Customer to resolve the issue.
  • - Immediate Termination: Severe, intentional, or repeat violations will result in service termination and account ban without refund.

# 26. Appeals Process

If your service was suspended due to a Policy violation, you may submit a formal appeal through our billing portal:

  • - The appeal ticket must state the steps you have taken to correct the issue and prevent future occurrences.
  • - Decisions on appeals are made by our administration team within forty-eight (48) hours of receipt and are final.

# 27. Service Restrictions

During an investigation, or if a service is flagged for high risk, SkyRainCloud may impose restrictions including:

  • - Disabling outbound SMTP traffic.
  • - Restricting backup download access.
  • - Restricting IP allocations or disabling custom port forwarding configurations.

# 28. Examples of Allowed Uses

Allowed uses of SkyRainCloud services include:

  • - Hosting active, optimized game servers for multiplayer gameplay.
  • - Operating development and testing environments for mobile, web, and cloud applications.
  • - Hosting personal and business websites, online shops, and database backups.
  • - Legitimate remote work, remote desktop sessions, and development tasks.

# 29. Examples of Prohibited Uses

Prohibited uses of SkyRainCloud services include:

  • - Runaway, resource-heavy botting or automation networks.
  • - Port scanning, brute-forcing, or host scanning without authorization.
  • - Storing large personal media directories, backup archives, or file sharing hubs on game/web plans.
  • - Launching network-sabotage scripts or outbound volumetric floods.

# 30. Policy Updates

SkyRainCloud reserves the right to modify, amend, or update this Fair Use Policy at any time. Changes will be posted to this page, and the effective date will be revised. Continued use of our Services constitutes acceptance of the modified policy.
